MASTER OPERATING FRAMEWORK

Policy Details

These terms govern the setup, ongoing maintenance, and management of business automation engines provided by Service Growth Solutions. Please review each section below.

Notice regarding prevailing agreements: These Terms of Service articulate the default operating policies of Service Growth Solutions. These terms complement, but do not replace, supersede, or invalidate any individually signed client agreements or Statements of Work (SOW). In the event of a direct conflict between these terms and an executed master service agreement or SOW, the terms of the signed document govern.

01. CRM Scope & System Architecture

Service Growth Solutions configures, deploys, and maintains cloud-hosted sales communication pipelines, automated lead follow-up protocols, calendar booking engines, and CRM data architectures for home and commercial trade contractors. Our role is strictly focused on systems integration, workflow automation, and operational infrastructure.

Core Service Domain Deployment Specifications Included Boundaries
Instant Response Engine Automated SMS triggers, missed call text-back, and immediate inbound lead notification routing. System integration and notification logic; telecom provider usage fees billed separately.
Nurture & Follow-Up Workflows Automated multi-stage sequences for estimate follow-ups, quotes, and cold prospect re-engagement. Logical flow rules and standard copywriting templates; does not guarantee third-party recipient replies.
Pipeline Architecture Customized stage design reflecting lead intake, estimation, scheduling, dispatch, and billing milestones. Standard CRM environment structure; does not include bespoke third-party enterprise ERP engineering.
Calendar & Dispatch Setup Technician synchronization, route-friendly scheduling calendars, and booking confirmation sequences. Calendar software connection; client maintains actual crew availability and calendar accuracy.

02. Client Responsibilities & Data Accuracy

Automated pipeline systems rely upon clean information. Clients must ensure that all customer lists, staff records, contact numbers, and estimate details imported into the system were lawfully gathered and remain accurate. Clients are solely responsible for compliance with regional telemarketing, TCPA, and messaging consent requirements regarding their inbound and outbound contact databases.

03. System Access & Credential Security

Administrative credentials, API keys, telephony logins, and webhooks issued to your organization must be maintained under strict internal security controls. You agree to notify Service Growth Solutions within 24 hours of detecting any unauthorized access, compromised passwords, or unauthorized pipeline data exports.

04. Fees, Billing Schedules & SOW Independence

All specific setup retainers, monthly maintenance figures, SMS/carrier direct charges, and consulting fees are governed exclusively by distinct, written Statements of Work (SOW) executed between Service Growth Solutions and the client. No pricing commitments are established via this general policy document. Invoices are payable per the net terms detailed on each individual billing agreement.

05. Cancellation, Work Pauses & Termination

Upon effective contract termination, ongoing automated follow-up sequences will be rendered inactive.

Specific cancellation terms are defined in the client's written agreement.

06. Intellectual Property & Workflow Ownership

You retain proprietary ownership of your business records, trade customer lists, proprietary quote estimates, and brand assets. Service Growth Solutions retains full ownership and licensing rights to its proprietary automation templates, workflow logic schematics, internal software scripts, and underlying communication architectures developed across client deployments.

07. Service Availability & Third-Party Outages

While we strive for maximum continuous uptime, pipeline delivery relies on external infrastructure including cellular carriers, SMS gateways, cloud databases, and email relay protocols. Service Growth Solutions is not responsible for delayed deliveries or dropped calls directly resulting from external upstream telecom outages, carrier filtering, or third-party server interruptions.

08. Limitation of Liability & Warranty Disclaimers

Important Liability Limitation

Under no circumstances shall Service Growth Solutions be liable for indirect, punitive, or consequential business damages, lost sales estimates, or missed trade revenues. Our aggregate cumulative liability arising under or related to your service engagement shall not exceed the total management retainer fees paid by you to Service Growth Solutions during the three (3) calendar months preceding the claim event.

Automated messaging architectures are designed to assist operational follow-up. Service Growth Solutions does not guarantee conversion rates, minimum signed contract quantities, or specific end-customer revenue returns from automated contact protocols.

09. Dispute Resolution & Governing Law

Both parties agree to pursue direct executive dialogue in good faith for at least twenty-one (21) business days prior to initiating formal legal claims. These terms are governed exclusively by the laws of the jurisdiction specified within your signed agreement, without regard to conflicts of law principles.

10. Policy Amendments & Periodic Updates

We periodically revise these operating policies to accommodate carrier telecommunication standards and platform feature upgrades. Updated terms become effective upon posting to this URL. Substantial operational updates will be communicated directly to primary account contacts via email.
